AAP gets court relief, Arvind Kejriwal taunts Centre over judgement


Especially in the times when Center was on the verge of planning deviously to take away ACB's power to arrest central officials, today's High Court ruling brings greatest relief to every Indian who had participated in the FIGHT AGAINST CORRUPTION MOVEMENT. This ruling would certainly boost Delhi Govt's morale to new high as Arvind Kejriwal comes out with flying colors with this win. The Centre Govt that was planning to downsize ACB gets downsized itself before it got into action to protect the corrupt officers.


Delhi high court in its ruling in favor of Arvind Kejriwal's Govt. visibly stood beside honesty and ruled that Delhi City government's ACB branch has all the power to arrest corrupt officers in Delhi police while dismissing the bail application of Anil Kumar, a head constable who had been arrested by the ACB in a case of corruption. His submission that the Anti corruption bureau of the capital doesn't have the jurisdiction to arrest and prosecute him was rejected unceremoniously by Justice Vipin Sanghi.


This upright and I would say historic verdict sends a clear message to PM and his ministers that if they try to tamper with the constitutional powers of ACB they would meet the same fate in the court. Many won't sleep today working in the center!


The honorable judge made it amply clear that the constable's arrest by ACB is well justified and within the jurisdiction of ACB's legal power. If you remember, a couple of days before there were rumors in the wind that Central Govt is planning to snatch away ACB's powers to arrest officials working for Center. Why do the officers need this protective layer in the first place from the center? Why? Do the officers really need to fear ACB if they are honest?  


The update on the case: The head constable's arrest had taken place on May 2 from Sonia Vihar Police station by the ACB. Ironically, on 14th May the high court had pulled up Delhi Police for questioning the jurisdiction of ACB after he was nabbed. The crime of the constable: A scrap dealer had lodged a complaint on the anti-corruption helpline 1033 that Anil Kumar (head constable) was demanding Rs. 20,000 as bribe from him and threatened to implicate him in some false case if he did not part away with the money.

Against this ruling, the center is preparing for the appeal in the SC and heading for another disastrous fiasco for I am pretty sure this entire exercise would be bootless since SC in most likelihood would uphold High Court ruling.
